Please read these terms carefully before using VisionPrompter. By accessing or using the Service, you agree to be bound by these terms.

1. Acceptance of Terms
By accessing or using VisionPrompter ("the Service"), operated at visionprompter.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, you must not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
2. Description of Service
VisionPrompter is an AI-powered SaaS platform that analyzes uploaded images using computer vision models and generates optimized text prompts for image generation tools (such as Midjourney, DALL-E, Stable Diffusion, and Flux). The Service is provided on a subscription basis with the following tiers:

5 credits per day (registered users) · 3 guest generations
Pro Plan — $19/mo
Unlimited generations · Premium models · Full history
Business Plan — $49/mo
Everything in Pro · API access · Priority processing
3. Account Registration
To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
4. Acceptable Use
You agree not to use the Service to:
- ✕Upload, transmit, or process images that contain illegal content, including but not limited to child exploitation material, non-consensual intimate imagery, or content that violates applicable law.
- ✕Attempt to reverse-engineer, decompile, disassemble, or derive the source code of the Service or its underlying AI models.
- ✕Circumvent rate limits, authentication mechanisms, or any security measures of the Service.
- ✕Use automated scripts, bots, or scrapers to access the Service without prior written authorization.
- ✕Resell, redistribute, or sublicense access to the Service or its generated outputs for commercial API resale purposes without a Business plan.
- ✕Upload images that infringe upon the intellectual property rights of third parties without proper authorization.
5. Intellectual Property
5.1 Your Content
You retain all rights to the images you upload. By uploading images, you grant VisionPrompter a limited, non-exclusive, revocable license to process your images solely for the purpose of providing the prompt generation service. The text prompts generated from your images are yours to use freely without restriction.
5.2 Our Content
The Service, including its design, code, branding, logos, user interface, and underlying technology, is the intellectual property of VisionPrompter and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without express written permission.
6. Billing & Subscriptions
Paid subscriptions are billed on a monthly recurring basis through PayPal. By subscribing to a paid plan, you authorize PayPal to charge the applicable subscription fee each billing cycle until you cancel.
Cancellation: You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your paid period.
Price Changes: We reserve the right to modify subscription pricing. Existing subscribers will be notified at least 30 days before any price change takes effect. Continued use after the price change constitutes acceptance.

7. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VISIONPROMPTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Disclaimer of AI Outputs
Prompts generated by VisionPrompter are produced by artificial intelligence models and are provided for creative assistance purposes only. We do not guarantee the accuracy, completeness, or suitability of any generated prompts. You are solely responsible for reviewing and using generated prompts in compliance with the terms of service of the third-party platforms where you use them (e.g., Midjourney, OpenAI, Stability AI).
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including for violations of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property, limitation of liability, and dispute resolution provisions.
10. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
11. Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
